Can I stay of spouse's insurance if filing for divorce and do not finalize it?

Trying to find out if I can stay on My spouse's insurance if we file for divorce but do not finalize it. I was told by a paralegal that I could if the divorce was not finalized. They said that it was better that a separation because would not have to pay twice if filed as a divorce and not a separation.
